Guernsey is Europe's premier captive insurance jurisdiction. The island’s long history of excellence and innovation in this field includes the invention of the protected cell company in 1997 – a segregated cell structure now used globally in other industry sectors, notably investment funds. Guernsey is also one of the world’s leading destinations for segregated cell captives, making local practitioners some of the most experienced in the use of such companies for risk management structuring. Guernsey is increasingly a European jurisdiction of choice for transformer vehicles, reinsurance side-car deals and insurance securitisation.
Like Guernsey, Jersey’s modern company law provides for both protected cell companies and incorporated cell companies. Its legal framework and insurance supervisory regime are in line with international best practice, but also recognise the need for a flexible approach to regulation. Our Jersey team, headed by Martin Paul, advises on these and other matters including the migration of insurance companies, Jersey insurance business transfer schemes, the effects in Jersey of English insurance business transfer schemes, and the establishment of business in Jersey.
